Recently, Routledge, a world-renowned publisher, has released the English academic monograph seriesMediation and Law in China, written byateam led by Professor Liao Yong’an ofXiangtanUniversity. The series consists of two volumes:Mediation and Law in China I: The Past, Present, and FutureandMediation and Law in China II: Development and Integration.
Rooted in China’s traditional dispute-resolution practices, mediation is a product of traditional Chinese culture and a distinctly Eastern approach to resolving disputes. General Secretary Xi Jinping pointed out: “We should explain and promote to the world more outstanding cultural achievements that feature Chinese characteristics, embody the Chinese spirit, and contain Chinese wisdom.” This series provides an in-depth study of the latest landscape of mediation in China. Mediation and Law in China I: The Past, Present, and Futureis co-authored by Professor Liao Yong’an and Assistant Professor Wang Cong fromtheLaw SchoolofHunan University. This volume mainly explores the essential attributes, jurisprudential foundation and historical evolution of mediation in China, as well as the feasible paths for the institutionalization, professionalization and legalization of mediation. It re-examines the concepts and models of traditional Chinese mediation, puts forward new concepts, models and mechanisms for the modernization of mediation in China, and discusses how to promote the professionalization and legalization of mediation in China to establish a mediation system suitable for Chinese society. It also introduces mediation and social governance models of different styles under diverse cultural backgrounds, and demonstrates China’s valuable experience in addressing the challenges of a“litigious society.”
Mediation and Law in China II: Development and Integrationis co-authored by Professor Liao Yong’an, Associate Professor Duan Ming, and Dr. Zhao Yiyu. This volume mainly introduces eight mainstream forms of mediation in China, including people’s mediation, court mediation, administrative mediation, industry-specific mediation, commercial mediation, lawyer-mediated mediation, online mediation, and the integrated arbitration-mediation mechanism. It explores how to promote the cooperation and interaction between traditional and emerging mediation practices while advancing the diversified development of mediation, so as to realize the organic integration within the mediation system. From multiple dimensions spanning history and reality, integrating Eastern and Western perspectives, combining theory and practice, and linking the state and society, this book uncovers the underlying logic of the diversified development and systemic integration of mediation in China.
